AfterShip SMS and AfterShip Email (collectively, the “Messaging Services”) are Services provided by AfterShip under its Terms of Service. These Services enable Users to send SMS messages (“SMS”) and emails (“Emails”) directly to their End-Users.

This SMS Content Policy (this “Policy”) applies solely to use of the Messaging Services. The examples provided are illustrative and not exhaustive.

Capitalised terms used but not defined in this Policy have the meanings given in the Terms of Service.

1. AFTERSHIP SMS AND AFTERSHIP EMAIL

1.1 General

AfterShip SMS and AfterShip Email enable Users to send SMS and email communications to their own End-Users for efficient, personalized interactions. These communications may include messages encouraging order completion, product recommendations, post-purchase support (such as order fulfilment), tracking updates, and other marketing-related purposes.

Users may customize the content of such messages (“Content”) and are solely responsible for the Content they transmit, including its legality, reliability, accuracy, appropriateness, and compliance with this Policy and applicable law. AfterShip disclaims all responsibility and liability for any Content, including any loss, cost, or damage arising from the User’s use of AfterShip SMS or AfterShip Email.

If the User enables End-Users or clients to send messages via AfterShip SMS or AfterShip Email, the User remains fully responsible for such activity. AfterShip may access, store, and process Content solely to operate the services and ensure compliance with applicable laws and this Policy..

1.2 Service Availability

AfterShip SMS and AfterShip Email are provided on an “as-is” and “as-available” basis and may not be accessible in all regions, at all times, or under all conditions. AfterShip disclaims all liability for delays, disruptions, or failures in the delivery or receipt of SMS or email messages, including issues arising from third-party service providers or telecommunications infrastructure. It is the sole responsibility of both the User and its End-Users to ensure they have an active network connection capable of sending and receiving messages..

1.3 Prohibited Content

By using AfterShip SMS and/or AfterShip Email, the User represents and warrants that all Content sent to any End-User complies with the following requirements::

  • Unlawful, Offensive, or Misleading Content: Content must not be false, unlawful, misleading, libelous, defamatory, obscene, pornographic, profane, indecent, lewd, suggestive, harassing (or advocate harassment of another person), threatening, offensive, invasive of privacy or publicity rights, abusive, inflammatory, inaccurate, inappropriate, fraudulent, or otherwise objectionable in AfterShip’s reasonable discretion.

  • Spam or Junk Messaging : Content must not constitute mass spamming, junk messages, or other forms of unsolicited or disruptive communication.

  • Irrelevant or Off-Topic Messaging : Content must be directly related to the User’s products or services and may not include commentary or messaging unrelated to such offerings, including political or social controversy or personal attacks.

  • Restricted or Regulated Commercial Content: Content must not include call-to-actions or offers involving products or services subject to local regulatory restrictions, including but not limited to alcohol, gambling, tobacco, firearms, health or medical devices, regulated pharmaceuticals, or adult services.

  • Personal Data Use : Content must not include personal data beyond what is strictly necessary, and is limited to the End-User’s name, birthday, email address, physical address, shipping information, order information, tracking details, purchased products, and viewed products.

  • Illegal or Infringing Material: Content must not depict illegal activity or promote conduct that is unlawful, including (i) content that infringes any third party’s intellectual property or privacy rights, (ii) depictions of illegal or dangerous acts such as rape or human trafficking, (iii) offers involving illegal products such as endangered animal products or illegal drugs, or (iv) media showing graphic or gratuitous violence or promoting violence.

  • Terrorism and Extremism: Content must not promote, support, incite, or glorify terrorism or terrorist acts, nor may terrorist organizations use AfterShip SMS or Email for any purpose.

  • Sexually Explicit Content or Exploitation of Minors: Content must not include sexually explicit material, nor may it sexually exploit or depict minors in any sexual context.

  • Discriminatory, Hateful, or Harmful Content: Content must not threaten or promote harm to oneself or others, harass, intimidate, or bully, or incite hatred, discrimination, or disparagement against any individual or group based on race, ethnicity, religion, disability, age, nationality, veteran status, sexual orientation, gender, gender identity, or any other protected status.

  • Impersonation and Deceptive Conduct: Content must not impersonate any person or entity, or otherwise contain false or misleading information about its source or affiliation.

  • Conflict of Interest: Content must not be created or submitted by employees, affiliates, or individuals with a vested interest in the product or service without appropriate disclosure.

  • Malicious Code and Security Risks: Content must not include viruses, corrupted data, or other harmful, disruptive, or destructive code or files, including trojan horses or similar malware.

1.4 Prohibited Message Categories and Regulated Content

Users must not use the Messaging Services to send Content that promotes, references, or contains material related to prohibited content, regulated categories, and related keywords (“Restricted Content”). To support enforcement of this Policy, AfterShip maintains a non-exhaustive list of prohibited content and related keywords (“Restricted Content List”), which may be updated from time to time and is available here. AfterShip may monitor Content sent through the Messaging Services to identify spam, abusive practices, and violations of this Policy. AfterShip reserves the right to block, withhold, or delete any message that includes references to Restricted Content or that otherwise violates applicable law or this Policy, without prior notice.

1.5 Right to Monitor and Remove Content

AfterShip is not obligated to monitor all Content but may do so for operational, legal, or policy compliance purposes. AfterShip may, in its sole discretion and without notice, edit, block, or delete Content that: (i) violates this Policy or applicable law; (ii) is reasonably necessary to protect AfterShip or third-party rights; or (iii) is otherwise deemed inappropriate or high-risk. This includes refusal to deliver Content that violates this Policy or presents a risk of legal liability.

1.6 Legal Compliance and Enforcement

The Messaging Services are provided to Users, and AfterShip has no direct relationship with End-Users. Users must ensure that Content complies with all applicable laws, industry guidelines (e.g., CTIA, CAN-SPAM), and regional or country-specific regulations applicable to the recipient of the message. Users are solely responsible for the legality of messages transmitted to End-Users

Users may utilize AfterShip SMS and AfterShip Email for marketing communications (respectively, “AfterShip Marketing SMS” and “AfterShip Marketing Email”). This Section 2 applies solely to such marketing uses and does not govern transactional or other non-marketing communications sent via AfterShip SMS or AfterShip Email.

User shall ensure that all messages sent through AfterShip Marketing SMS or AfterShip Marketing Email are directed exclusively to End-Users who have provided their prior, express, and valid consent. By using these marketing features, the User represents and warrants that it has provided all required disclosures and obtained such consent in compliance with applicable laws and regulations, including but not limited to those governing electronic communications, consumer protection, and data privacy.

End-Users must be able to withdraw consent at any time. Upon such withdrawal, the User must immediately cease all marketing communications to that End-User via AfterShip Marketing SMS or AfterShip Marketing Email. AfterShip strongly recommends that Users include clear and user-friendly unsubscribe instructions in the initial message to each End-User..

3. AFTERSHIP SMS: COUNTRY-SPECIFIC GUIDELINES

This Section applies solely to AfterShip Marketing SMS and does not apply to (i) AfterShip Email or (ii) AfterShip SMS when used for non-marketing purposes.

The AfterShip Marketing SMS service is available only to Users established in the following countries: the United States, the United Kingdom, Australia, Canada, Germany, Spain, Italy, New Zealand, and France.

Users must comply with the AfterShip Marketing SMS Country-Specific Guidelines, which may be updated by AfterShip from time to time at its sole discretion. It is the sole responsibility of each User to ensure that its use of AfterShip Marketing SMS complies with all applicable laws, rules, and industry standards in the jurisdiction(s) where End-Users are located.

AfterShip disclaims all liability for any loss, cost, or damage arising from the User’s use of AfterShip Marketing SMS or the Content transmitted via the service. The User acknowledges and agrees that it bears sole responsibility for compliance with applicable legal and regulatory obligations and irrevocably releases AfterShip from all claims, demands, and damages—actual or consequential, known or unknown, suspected or unsuspected, disclosed or undisclosed—arising from or in any way connected to such compliance.

4. INDEMNITY

In addition to the indemnification obligations set forth in the Terms of Service, you agree to indemnify, defend, and hold harmless AfterShip and its affiliates, officers, directors, employees, agents, and service providers (collectively, the “Released Parties”) from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, fines, penalties, costs, and expenses (including reasonable attorneys’ fees and court costs), arising out of or relating to: (a) your or any End-User’s use of AfterShip SMS; and (b) any Content transmitted or caused to be transmitted through AfterShip SMS.
