Automizely Pte. Ltd. ("AfterShip", "we", "us", "our") and any and all Affiliates (collectively "AfterShip Group") recognise the importance of privacy. AfterShip will manage your Personal Data collected through the Application based on AfterShip belief of respect for the individual and in accordance with this Privacy Policy.

BY USING THE APPLICATION IN ANY WAY, INCLUDING NAMELY BY MAKING AN END-USER ACCOUNT AND USING ANY OF THE SERVICES PROVIDED THROUGH THE APPLICATION, YOU AGREE TO THE AFTERSHIP PRIVACY POLICY ("Privacy Policy"). If you do not agree with this Privacy Policy, please do not provide Personal Data and please do not use the Application. All terms in this Privacy Policy shall have the meaning attributed to them in AfterShip End-User Terms of Use (“Terms of Use”). THIS PRIVACY POLICY IS ONLY APPLICABLE TO THE END-USERS USING THE APPLICATION.

1. Personal Data Collection

We collect Personal Data about end-users using the Application ("End-User", "you", "your"). We collect Personal Data to provide the services you request, to improve the End-User's interaction with AfterShip, and to communicate with you about shipping information, services, promotions and contests. We limit the collected information to support the intended purposes of collection. If you cannot be identified by the data we collect, for example when personal data has been anonymised, then this data shall not be considered Personal Data.

1.1 When Do We Collect Personal Data?

We collect Personal Data when you:

  • Create an account on the Application;
  • Use the Application;
  • Make a service request from AfterShip through the Application;
  • Request customer service or contact us;
  • Link an email account or other third-party account to your Account;
  • Submit a review or post any End-User Content through the Application; or
  • Generally when you submit Personal Data to AfterShip.

When you ask us to provide services for the benefit of a third party, you represent that you are legally authorised by said third party to disclose Personal Data to AfterShip. This authorisation shall cover all categories of Personal Data described herein including but not limited to the name, address, phone number, email address, order information and shipping information of said third party.

1.2. Access and Parsing

By using the Application, you authorise AfterShip to access your email account in order to scan the emails contained therein for information, including the categories of Personal Data set out in this Privacy Policy, for the sole purpose of providing AfterShip services. Processing occurs upon use of the Application and is strictly limited to identifying and extracting information related to AfterShip services. In addition, AfterShip may also retain and analyse a limited subset of email data as part of its improving and enhancing its Application related services for an improved user experience, focusing on identifying and extracting tracking, shipment and order-related information. As part of this process AfterShip will use reasonable efforts to remove and/or anonymise any sensitive personal data that may be identified in the course of such processing.

1.3. Categories of Personal Data

AfterShip collects and processes the following categories of Personal Data:

a. Account information: End-User identification information such as name, log-in credentials, address, email address, phone number, platform account ID.

b. Tracking Data: the AfterShip Tracking Data related to the End-User. This covers an overview of the past and present parcel tracking information: ship from address, shipping address, checkpoint address, delivery location, signed by name, link to the proof of delivery, reference number, pickup location, pickup note, signature image, recipient contact information, carrier name, shipping method, box type, parcel weight, ship date, number of individual packages, delivery status, delivery date, expected delivery date, proof of delivery file.

c. Application use and Service requests: the generation of extracts of specific sets of Tracking Data requested by the End-User upon request and technical information related to the use of different Application features.

d. Customer service data: Personal Data generated in relation to any customer service requests made by the End-User, such as name, technical problems or other complaints formulated by the End-User.

e. Order data: order information which includes order number, End-User platform account ID, coupon code, gift card code, checkout token, tracking url, IP address, order value, order date, order platform tag, shipping fee, item name, item value, item amount, item link, item number, item variant, item brand, coupon information, order status, transaction ID, capture ID, order ID.

f. Device information: device ID, device type, device version, os type, os version, browser type, browser version.

g. Shipment review data: Shipment review content, review date.

h. Email content: content of the emails that were parsed when the End-User enables parsing services in order to provide and improve AfterShip services.

The source of Personal Data processed by AfterShip is originating (i) directly from the End-User (for example, when you add a tracking number to your Account), (ii) from email parsing when you link your email account to your Account and (iii) from Users (Users are merchants (individuals/entities) through which you have directly placed product purchase orders), based on your request to AfterShip to manage your shipments by installing the Application.

2. How We Use Your Information: Purposes of Processing and Legal Grounds

AfterShip uses your Personal Data and usage information to offer and provide services and to support its core business functions. These include service fulfilment, customer service, internal business processes, marketing (including contests and sweepstakes), authentication, loss and fraud prevention, and legal functions. In addition, when Personal Data is no longer needed, AfterShip may anonymise your Personal Data in order to improve its services.

Some examples include:

  • To fulfil your requests for services and communicate with you about said requests;

  • To send you notifications concerning shipment information;

  • To register your account on the Application;

  • To administer surveys, contests, sweepstakes and promotions;

  • To provide customer service;

  • To help us improve and customise the Application and its operational methodologies;

  • To send you information about our services, promotions, contests and sweepstakes; and

  • To protect the security or integrity of the Application and our business.

AfterShip processes Personal Data for the following purposes and based on the following legal grounds:

For the performance of AfterShip Application services: the extraction of Tracking Data. This element covers all technical and commercial processes required to carry-out user requests Processing is necessary to perform a contract with the End-User, or in order to conclude one.
To improve the Application, personalise the user experience, and enhance user interactions with the Application. Processing is based on AfterShip’s legitimate interest to conduct its business, improve its product and service offerings, and facilitate communication
Promotional communications Processing is based on your consent, this can be managed through the Application’s settings
To link various user accounts (i.e. the AfterShip Account with other social media or email accounts) and extract information (such as tracking data) for specialised requested services Processing is based on your consent: Further Personal Data you provide through linking different user accounts, is done on a voluntary basis.
To provide customer service and ensure the security of our operations Processing is necessary to perform a contract with the End-User.
Personal Data you provide in connection with the AfterShip Services is anonymised and used by AfterShip for data analysis. Anonymised data is used (i) to create reports based on data analysis with regards to the AfterShip Services; and (ii) provide insights into trends based on usage of the Application that may indicate trends among End-Users for the benefit of Users. The act of anonymising the personal data is processed on the basis of AfterShip’s legitimate interest to conduct research and development activities, pursue avenues of innovation and improve its services. Once the personal data has been anonymised it is no longer linked to any End-User and is no longer subject to personal data regulation.
Personal Data retrieved from your emails may be processed to improve and enhance the services provided by the Application. Processing is based on AfterShip’s legitimate basis to conduct its business, improve its product and service offerings, and facilitate communication.

3. Storage

The Personal Data requested with regard to the creation and use of an Account is necessary for the performance of AfterShip Services and to fulfil your requests.

The Personal Data related to the Account will be stored in the Application in accordance with AfterShip’s data retention policies. Your Account shall remain active unless it becomes inactive. In such case, after one (1) year of inactivity, AfterShip shall delete your Account, along with any data contained therein provided however that deletion process may take up to forty-five (45) days. In the event applicable data protection law requires AfterShip to delete your Account before the established policy, AfterShip shall comply with such legal obligation, even without notification to you.

4. How We Disclose Your Information Outside AfterShip

AFTERSHIP DOES NOT SELL OR LICENSE YOUR PERSONAL DATA TO ANY THIRD PARTIES WHATSOEVER.

We only disclose your Personal Data with your prior consent or as provided in this Privacy Policy. Data analysis reports and any other documents based on anonymised data may be sold or licensed to third parties.

4.1 Service Providers and Vendors

We may transfer or disclose your Personal Data within the AfterShip Group. Moreover, we may disclose or otherwise make available your Personal Data, including transaction information, to other service providers and vendors for the purpose of managing, providing, and improving AfterShip services. Examples are shipping companies, vendors, payment companies, credit card processors and other payment service providers such as PayPal, financial institution partners, hosting and maintenance providers, data storage and other technical service providers. Generally, companies that help us to provide AfterShip Services and improve our product and service offerings and our Applications.

For End-Users in Switzerland, the United Kingdom and the European Economic Area (“Europe”), please note that your Personal Data will be transferred to recipients outside Europe. In the case of any such transfers, we will use best efforts to ensure that your Personal Data is adequately safeguarded through the implementation of standard data protection clauses according to applicable laws and regulations of Europe. 4.2 Legal Requirements and Protection of Our Company and Others

We may access, preserve and disclose your Personal Data in other special circumstances, namely (a) to enforce the Terms of Use; (b) to respond to claims that any content violates the rights of third parties; (c) to protect the safety, property, or other rights of AfterShip Group, AfterShip customers, associates, or any other person; or (d) where otherwise required by law. Examples include protecting the health or safety of customers, addressing crimes committed on or through the Application, or in response to a search warrant, subpoena or other legally valid inquiry or order, or as otherwise required by applicable law.

4.3 Business Transfers

We may transfer any information we have about you in connection with a merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of AfterShip Group or as part of a corporate reorganisation or other change in corporate control.

4.4 Google Data

Notwithstanding anything to the contrary in this Privacy Policy or the AfterShip Terms of Use:

  • Google Data will only be transferred to others if necessary to provide or improve user-facing features that are prominent in the Service’s user interface or as necessary to comply with applicable law or as part of a merger, acquisition, or sale of assets with notice to you; and

  • Google Data will not be transferred for serving ads, including retargeting, personalised, or interest-based advertising.

5. Your Rights

You have the following legal data protection rights under the relevant legal conditions:

  • To request access to your Personal Data;

  • To obtain the rectification of any inaccurate Personal Data;

  • To obtain the erasure of Personal Data, under certain conditions;

  • To limit the processing activities to which the Personal Data is subject, under certain conditions;

  • To receive your Personal Data in a structured, commonly used and machine-readable format, and have the Personal Data transmitted to another controller, under specific conditions;

  • If processing is based on consent, to withdraw consent at any time (although this does not impact the lawfulness of past processing activities);

  • To the extent any automated decision making would be involved, you have the right not to be subject to a decision (which engenders legal effects) based solely on automated decision making;

  • To lodge a complaint with the national supervisory authority. The responsibilities of the data protection authorities depend on the seat of the competent authorities. You may, however, contact the data protection authority, which will then forward your complaint to the responsible authority. The competent authority for AfterShip is the Data Protection Authority of the Kingdom of Belgium, located at: Drukpersstraat 35, 1000 Brussels, Belgium; and

  • To non-discrimination.

You can access, update and/or remove your Personal Data, including contact or account information, by accessing Your Account. If you would like to exercise your data protection rights you can contact our Privacy Team by sending an email to [email protected].

In order to ensure that your data is not disclosed to third parties in the course of requests for information, please attach sufficient proof of identity to your request by email or post.

6. How to Unsubscribe to Direct Marketing

We want to communicate with you in the ways that you want to hear from us. If you no longer want to receive marketing messages from us, you can click on the appropriate link at the bottom of our marketing emails. Please allow sufficient time for your preferences to be processed.

If you no longer want to receive delivery notifications from us, you can either change your delivery notification triggers by changing Your Account Delivery Notifications or by clicking on the appropriate link at the bottom of our delivery notification emails. Please allow sufficient time for your preferences to be processed.

7. How We Secure Your Information

Securing your information is important to AfterShip. We maintain physical, electronic, and procedural safeguards to protect the confidentiality and security of information transmitted to us. However, no data transmission over the Internet or other network can be guaranteed to be 100% secure. As a result, while we strive to protect information transmitted on or through the Application, we cannot and do not guarantee the security of any information you transmit on or through the Application, and you do so at your own risk.

AfterShip accounts require a username and password to log in. You must keep your username and password secure, and never disclose it to a third party. Due to sensitivity of the information contained in AfterShip accounts, account passwords are encrypted, which means we cannot see your passwords. We cannot resend forgotten passwords either. We will only reset them.

8. Online Protections

Your account information is protected by the password you use to access your online account. Please keep this password confidential.

9. Privacy of Children Online

We are committed to protecting children's online privacy. In order to protect the privacy of children, AfterShip does not knowingly collect Personal Data from children under the age of 18 without prior parental consent. If we become aware that we have inadvertently received Personal Data from a child under the age of 18, we will delete such information from our records.

10. LIMITATION OF LIABILITY

EXCEPT WHERE PROHIBITED BY LAW, UNDER NO CIRCUMSTANCES SHALL AFTERSHIP BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF AFTERSHIP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF AFTERSHIP USE OF THE PERSONAL DATA OF ANY THIRD PARTY PROVIDED BY YOU AND/OR YOUR COMPANY. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. In some jurisdictions, some of the foregoing limitations may not apply.

11. Links to Other Applications

Our Application may contain links to other websites. A link to a third party's website does not mean that we endorse it or that we are affiliated with it. We do not exercise control over third-party websites. You access such third-party websites or content at your own risk. You should always read the privacy policy of a third-party website before providing any information to the website.

12. International

As a global company, AfterShip may process, store and transfer Personal Data in the United States or in any other country in which any company of the AfterShip Group operates. AfterShip requires that all companies of AfterShip Group adequately safeguard your Personal Data, regardless of where it is stored, through the implementation of standard data protection clauses adopted by the Commission or other equivalent mechanism.

13. Changes to this Privacy Policy

AfterShip may change the Privacy Policy from time to time. We will inform you by posting the revised Privacy Policy on the Application. Please check our Privacy Policy periodically for changes. We will post the date the Privacy Policy was last updated at the top of the Privacy Policy. The changes will go into effect on the "Last Updated" date shown in the revised Privacy Policy. By continuing to use the Application, you consent to the revised Privacy Policy.
